Legal Questions about Financial Aid?
T R asked the question:
I’m having a big issue, as many have, with University of Phoenix. This is a long one…bare with me.
I enrolled at UoP, was told by my enrollment counselor that my financial aid was completely finished, and began classes. I took two classed, but personal reasons took me out of town, which would make me miss two classes, which withdrew me from the course.
I called my counselor to tell her that I needed to miss class before I even left, and asked if I needed to do anything to make sure I wouldnt be responsible for any financial problems. She told me I could leave town and that she’d take care of any issues.
Now I’m being told that I owe $700 for being withdrawn, because my financial aid wasn’t complete (like I said, they told me it was PERFECT).
My question is this: I did lie about the reason I had to leave town when I spoke to my enrollment counselor. If I happen to try to get my lawyer involved and file a lawsuit, will they even bother with looking at WHY I left town and missed class in the first place? or will that even matter? I have a bunch of emails they sent me and can prove that they told me I could leave town without trouble….but will that white lie ruin my lawsuit? Should I even get the law involved?
they say I owe them the money because they never recieved my financial aid from sallie mae. This doesn’t seem right to me, because I had contacted the FA department many times to make sure that my FA was good to go, and even received emails from Sallie Mae saying that they were ready and able to pay the school my FA.

Is it okay to ask for financial help if I’m destitute?
funsunjoy asked the question:
I was in a horrible marriage and filed for divorce when my daughter was two years old. My ex dragged out the divorce for three years and I had to pay for my own defense. I had two amazing friends that paid for the majority of my legal fees. I paid the balance and it caused me to file for bankruptcy. I recently lost my job and I’m having a difficult time finding another right away. I’m down to my last $800. My last choice and resort is to call one of these people and tell them what is going on. Do you think they will be angry because I didnt’ approach them sooner or do you think they wished I didn’t contact them. I’m desperate and embarrassed

Legal requirements for Tennessee Nonprofit Corps. to disclose financial statements to the general public?
Shane C asked the question:
I’m actively involved with a organization that is chartered Nonprofit in the State of Tennessee. As of recently I am concerned that the financial well being of the organization is not being properly maintained.
I am not an officer with the organization, and since the organization has no members (for legal reasons), I am technically not a member. For all intents and purposes I am part of the general public that happens to donate a couple hundred hours of service a month, as well as financial support to this organization.
My question; Is there a relevant section of the Tennessee Revised Code for Nonprofit Corporations, that would require financial statements be reviewable to the general public?

Is it legal for an employer to take money from your paycheck to cover a company credit card charge?
jane_jane asked the question:
The company I work for recently informed staff that if we lose a receipt for a company credit card charge we made, they will take the money from our paycheck–because without the receipt, to them it appears like we’ve made a personal purchase. Is this legal? They say it is, b/c they consider it a personal “draw” on our pay, even though it clearly would not be an employee-initiated draw. We’ve signed nothing indicating that we agree with this policy, and it isn’t in the HR handbook. Basically, this new policy is the arbitrary decision of the financial manager. How can this be legal?

What kind of legal service should I get in order to get a negative rating given by mistake removed?
lcente asked the question:
Both parties agreed in writing that the rating was given by mistake and requested the removal, now the site refuses to remove the rating which causes financial loses to me and stains my reputation. So I need a court order or something like that to get it removed/changed. However, since I don’t live in the US, I don’t know how or where to get online legal help.
“The site” is a service provider like eBay, and it’s US-based. I live in Germany and the other party in Portugal. We both contacted the site to get the bad rating removed or changed since it was a mistake, and they refuse to remove it. All sites, including eBay, offer a way to remove feedback when both parties agree, but the site I’m dealing with refuses, so I need to put legal pressure on them. Their rules say that if they get a court order, they will abide to it. I hope thic clarifies the question and thanks for your help.

What would be a legal/tactful method of getting an ex spouse to quit meddling in our financial affairs?
aichausa asked the question:
I am not sure who I should ask this question~~maybe legal advice?
My husband’s retired from the military. He gets a certain amount per month. Even though his child turned 18 last month, he’s still paying the same amount to his ex wife, and she’s (we’re told) sending this money to him (an allotment). The ex contacted my husband, telling him that she called the number, through the military, to have direct deposit set up so that she would no longer need to receive them via snail mail. However, she posed as his current spouse and provided the clerk with his SSN to have dir dep set up. His original intent was to continue with the amount of $350. She had it changed to $700. She consulted him about this after she had this done. ***Are you seeing where I am going with this?*** Now, he called me this morning to tell me about this. I was so furious I almost came unglued. Reasons are obvious.
My question is this: What is the best way to stop her meddling in our financial affairs?

Spaznski~~Fascinating. I think the bottom line is that I am not being told everything. I am told many things by different respondents and the responses of yours and one other’s adds up, so far. I am not getting the full story. Period. I think that I should let this one go. Only my husband and his ex know what it is. Thanks for your input.
Chels~~Direct deposit is not the issue. You’re missing the point. Direct deposit is anyone’s right. It’s the increase in the funds taken out of his retirement check without his knowing about it. She called DFAS one day, according to my husband, and then telephoned my husband the next to let him know about this. Her sole purpose is to get two months back child support payments which, yes, she’s fully entitled, but the way my husband explained to me the method of her going about it sounds, very to me to be crimina. However, I did some research and discovered that not only does one need a password, but one cannot make any changes in funds withdrawn from retirement besides the retiree him/herself AND it has to be approved through court. The way my husband relayed it was that she spoke to a clerk, gave the SSN and…BOOM, done. Went from $350 to $700 in a matter of a few clicks set to be withdrawn April 1st from my husband’s retirement. I don’t buy it. Not plausible.

How does one get experience as a financial analyst?
Jeremy asked the question:
All financial analyst jobs seem to require 1 to 2 years experience as a financial analyst. So how does one ever get that experience if you can’t get a job without it?
I have a degree in Finance, but since college I’ve worked as a legislative aide and a legal assistant. I’d still like to be a financial analyst if I had the chance, to use my degree and because it pays well but I don’t know how to break into that industry.

Should a man be allowed to abort his financial responsibility?
HooKooDooKu asked the question:
When a woman gets pregnant, she has the legal right to relinquish all responsibility towards the unborn child by having an abortion.
The father, by contrast, has no legal rights. He can neither force the woman to have an abortion, nor can he prevent her from having an abortion (and I don’t think he should be allowed to either). Additionally, even if he wants to walk away from the situation, the mother can sue him for child support.
But if a woman has the legal right to abort the baby, then shouldn’t the father have the legal right to abort his financial responsibility for the child? Shouldn’t the father be allowed to avoid paying child support if he provides the financial means (let’s say $1,000 just to put a reasonable dollar amount on it) for the mother to have an abortion but she refuses to?
I’ll admit that proposing such a law sounds ridiculous. But when you compare the man’s position to the woman’s position, doesn’t her options seem just as ridiculous.
For those trying to argue the point “the man made his choise when he slept with her”, please try to realize how rediculous that point makes in the context of this question. What you’re really doing is adding arguments to why abortion should NOT be legal (with the exception of rape)… “she made her choise when she slept with him”

A financial advisor hacked into a new cr. card acct. and transferred a balance w/o my knowledge. Is this legal?
cardinalscove2 asked the question:
I hired Mutual Consolidated Savings to help me pay down my debt faster. The financial advisor advised me to open up a new credit card account with a 0% finance for 12 mo. and then transfer some credit card balances over to that one. I have had no contact with my advisor since I received my new credit card and I never called him with my new account number to help me transfer balances. Somehow he managaed to get into my new account and transfer other credit card balance without my knowledge. The credit card company said the transaction took place over the internet. He had to hack into my new account! Is this even legal?
